These Terms of Service ("Terms") govern your access to and use of NEXTALE's website, mobile apps, and related services (together, the "Service"), operated by NEXTALE ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
NEXTALE is an open platform for short vertical video series, in any genre, from any creator, including AI-generated content. Viewers can browse, watch, and unlock episodes through coins, subscriptions, or free previews. Creators can apply to publish their own series, subject to a separate review process and creator agreement.
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or make a purchase on NEXTALE. Some content on NEXTALE is intended for mature audiences and is labeled accordingly; you're responsible for complying with any age-rating requirements that apply where you live.
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at play@nextale.com if you suspect unauthorized use of your account.
NEXTALE offers monthly subscriptions and coin packs to unlock episodes. Prices are shown before purchase. Subscriptions renew automatically each month unless cancelled before the renewal date; we don't offer weekly billing, and episode prices don't increase partway through a series. Payments are processed by third-party payment processors; by making a purchase, you also agree to their applicable terms.
Refunds are handled on a case-by-case basis in accordance with applicable law and the policies of the app store or payment processor you purchased through.
Creators who wish to publish content on NEXTALE go through a separate application and review process, governed by our Content Preview Submission Terms and, upon approval, a separate Creator Agreement covering publication, licensing, and revenue share. These Terms of Service govern your use of the Service generally; they don't by themselves grant any right to publish content on NEXTALE.
You agree not to:
The NEXTALE name, logo, and platform are owned by NEXTALE. Content published by creators remains owned by those creators, licensed to NEXTALE as described in the applicable Creator Agreement. Nothing in these Terms transfers ownership of creator content to NEXTALE.
We may review, restrict, label, or remove content that violates our content policies, applicable law, or third-party rights. We don't guarantee that any specific piece of content will remain available indefinitely.
The Service is provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. We don't guarantee that the Service will be uninterrupted, error-free, or that any particular content will be available at any given time.
To the maximum extent permitted by law, NEXTALE will not be liable for indirect, incidental, consequential, or special damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the six months before the claim arose, or $100, whichever is greater.
You may stop using the Service at any time. We may suspend or terminate your account if we reasonably believe you've violated these Terms, applicable law, or created risk or harm to NEXTALE or others.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
We may update these Terms from time to time. If we make material changes, we'll notify you by posting the updated Terms on this page with a new "Last updated" date, and where appropriate, through other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Questions about these Terms can be sent to play@nextale.com.
